Terms of Service

These terms are the agreement between you and Landroamer. By creating an account or using the app, you accept them. If you don't agree, don't use Landroamer.

Read section 3 if you read nothing else. Offroad driving is dangerous. Landroamer is a planning and navigation aid, not a safety system and not a substitute for your own judgment. You are responsible for your safety, your passengers, and your vehicle.

1. Your account

You need an account to use Landroamer. You must be at least 13 years old, and if you're under 18 you need a parent or guardian's permission. You're responsible for keeping your login secure and for everything that happens under your account. Give us accurate information and keep it current.

2. What Landroamer is

Landroamer provides trail information, trip planning, navigation guidance, and social features for offroad and overlanding travel. Trail data comes from our own field experience, public sources, and content contributed by other users.

2a. Trail information is not a guarantee

Trail conditions change constantly and without warning. Weather, seasonal closures, washouts, rockfall, fire, snow, private-property changes, and agency decisions can all make a trail impassable or illegal to drive between the time information is recorded and the time you arrive.

Difficulty ratings are subjective. A rating reflects one person's assessment with one vehicle on one day. Reports of what other vehicles have run a trail describe what those drivers experienced — they are not a prediction about your vehicle, your skill, or the conditions you'll find.

Every Landroamer trail is mapped by hand — from the first-hand experience of local drivers who have completed the trail, or from publicly available sources such as Forest Service Motor Vehicle Use Maps (MVUM), satellite imagery, and Forest Service and National Park road maps. A mapped route can differ from what you find on the ground: trails get rerouted, gated, washed out, and reshaped over time. Always follow posted signage and the rules of the county and managing land agency — what's on the ground overrides what's in the app.

Difficulty ratings start as a seed. Every trail is given an initial 1–10 rating when it's mapped, and that seed may differ from commonly known or previously published ratings for the same trail. As the community runs a trail and submits their own ratings, the displayed difficulty becomes the average of those reports — a more current reading, but still an opinion, not a measurement. The number can move as conditions change, and the trail on the day can differ from any number.

Trail names are not standardized. Some trails appear under their commonly known names; others go by different local conventions. Use the mapped route — not the name alone — to confirm you're navigating to your intended destination.

If you believe a trail route is inaccurate, submit a concern using the report form at the bottom of any trail page in the app. Community reports are how this data stays current.

Always verify conditions and closures with the managing land agency before you go, and confirm you have the legal right to be on any route you drive.

3. Safety, risk, and your responsibility

This section is the most important one in these terms.

Offroad driving and overlanding are inherently dangerous activities that can result in property damage, serious injury, or death. Risks include vehicle rollover and mechanical failure, becoming stranded in remote terrain without communication, exposure, water crossings, falling objects, wildlife, other vehicles, and the loss of any ability to summon help.

By using Landroamer, you agree that you assume all risk associated with your travel, on and off pavement. Specifically, you acknowledge and agree that:

Insurance

Confirm with your insurance provider that you and your vehicle are covered for offroad use before you participate in any offroad activity. Many standard auto policies exclude offroad driving, damage occurring off maintained roads, and recovery costs. This is your responsibility to verify, not ours.

Release of liability

To the fullest extent permitted by law, you release Landroamer, its owners, developers, employees, and contractors from any and all claims, demands, damages, losses, or causes of action arising out of or related to your use of the app or your participation in offroad or overland travel — including any accident, injury, death, property damage, vehicle damage, recovery cost, delay, becoming stranded, trespass, citation, or any other unforeseen event, whether or not caused in whole or in part by information provided through Landroamer.

4. Your content

You keep ownership of everything you post — photos, run logs, trail reports, campsites, comments. By posting, you grant Landroamer a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that content within the app for the purpose of operating the service, and to display it to other users according to the visibility you selected.

You confirm you have the right to post what you post, and that it doesn't infringe anyone else's rights. If we want to use your content in marketing outside the app, we'll ask you first.

5. Rules of use

Don't do these things:

We may remove content or suspend accounts that break these rules.

6. Subscriptions and payment

Some features require a paid subscription. Subscriptions are billed through the Apple App Store or Google Play according to their terms, and they — not Landroamer — process your payment.

Subscriptions renew automatically unless you cancel at least 24 hours before the period ends. Manage or cancel in your Apple or Google account settings. Free trials convert to paid unless cancelled before the trial ends. Refunds are handled by Apple or Google under their policies. We may change pricing with reasonable notice; changes won't affect a period you've already paid for.

7. Availability

We work to keep Landroamer running, but we don't guarantee it will be available, uninterrupted, or error-free. We may change, suspend, or discontinue features at any time. Offline features depend on you having downloaded content in advance.

8. Disclaimer of warranties

Landroamer is provided “as is” and “as available,” without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that trail data, difficulty ratings, conditions, routes, distances, times, weather, or any other information in the app is accurate, complete, current, or suitable for your use.

9. Limitation of liability

To the fullest extent permitted by law, Landroamer and its owners, developers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or for personal injury, death, or property damage, arising out of or related to your use of or inability to use the app — whether based in contract, tort, negligence, strict liability, or any other theory, and whether or not we were advised of the possibility of such damages.

Where liability cannot be excluded, our total aggregate liability to you is limited to the greater of the amount you paid Landroamer in the twelve months before the claim arose, or one hundred US dollars ($100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for personal injury or certain damages. In those places, the above exclusions and limitations apply only to the extent permitted by law, and nothing in these terms limits any right you have that cannot lawfully be limited.

10. Indemnity

You agree to indemnify and hold harmless Landroamer and its owners, developers, employees, and contractors from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your use of the app, your content, your violation of these terms, or your violation of any law or third-party right.

11. Ending your use

You can stop using Landroamer and delete your account at any time from Settings. We may suspend or terminate an account that violates these terms, or where required by law. Sections 3, 4, 8, 9, 10, and 12 survive termination.

12. Governing law and disputes

These terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Colorado, and you consent to their jurisdiction. If any provision of these terms is found unenforceable, the rest remains in effect.

13. Changes

We may update these terms. If a change is material, we'll update the date above and notify you in the app or by email before it takes effect. Continuing to use Landroamer after that means you accept the new terms.
